Monday, June 30th

Director Hubert Guevara of the SEC and his staff met this morning with PIPC victim complainants to explain that those in the first batch of complainants may file additional affidavits if the specific respondents/agents were dropped by the DOJ.  In short, the PIPC victim complainants may provide additional details, highlight and emphasize previous or new details, etc. to show why the specific respondent should not be dropped from the charge sheet.  Any new affidavits with new information should be submitted to the SEC no later than this coming Thursday.  The SEC will use these new affidavits in their appeal to overturn the DOJ resolution dropping the specific respondents from the charge sheet.

The SEC is also appealing to all other PIPC victims who have not yet filed any complaint to do so before it is too late.  Any new complaints will be filed with the DOJ as part of the second batch very soon. 

Every victim is reminded that if you do not file a complaint, you cannot recover your money.  Those who file a complaint have a good chance of recovering some of their losses as the court will order any and all respondents found guilty to compensate the victims for their losses.

how does one go about filing a complaint? does any other of you out there feel thats its not nessecary to do this? any comment on this issue? tnx

Isn't it kind of foolish for you to ask that kind of question here? Is it not obvious that the scammers can simply post here anonymously and state that it is wrong to file, or that you might jeopardize and expose yourself if you file, etc., and all that garbage.  The bottom line is this:  If you want any chance at recovering any of your losses then you have no choice but to file before it's too late.  If you don't want to file, then don't expect to get your money back, because you won't.

I am very surprised by your post, since you have access to the Pure Investors section,  and how to file a complaint is all over that section.  Please review all the topics in the Pure Investors section and you will see the answer.

Inspite of so many previous postings with SEC contact information, I continue to receive many private messages asking for contact information for the SEC department responsible for filing charges, so here it is again:

If you will email your documents, I strongly suggest that you email it to both Director Guevara and Atty. Margate to ensure receipt, PLUS make sure to ask for an acknowledgment.  Also, bear in mind that any documents that are NOT notarized are totally useless, and cannot be used by the SEC in their complaint.  So please make sure to have your docs notarized BEFORE sending them to the SEC, or it will just be a waste of time.  Again, there is very little time left, so you must attend to this immediately if you want any chance of recovering some of your money.

Note that your complaint-affidavit must include a list of all the documents you received from PIPC and must be attached to your complaint, as follows:

Attachment A:  Laminated receipt
Attachment B:  Welcome To PMP letter
Attachment C:  Letter Confirmation of Fixed Deposit Advice
Attachment D:  Fixed Deposit Advice
Attachment E:  Soft-bound Book Contract containing Partnership Application, Portfolio Management Partnership Agreement, Security Agreement, Declaration of Trust, and Consent to Disclosure

Note:  If you do not have all of the above documents, just attach whatever you have.

2) Follow these steps when preparing and filing your complaint:

- prepare and finalize the affidavit.
- attach all the documents and other evidence you might have
- NOTE:  If you are not confident that you have prepared the affidavit properly, bring it first to the SEC and have them review it BEFORE you have it notarized (so you do not waste money)
- have the last page notarized (or consularized if you are not in Metro Manila), which costs about a total of P100
- have 4 copies made of the entire (already notarized) set - affidavit plus all attachments
- bring a total of 5 sets (the original plus the 4 copies) to the SEC and ask for any lawyer handling this case where your complaint will be "assessed"
- you will be asked to pay the filing fee of P510.00, after which they will "receive" your complaint and give you back a copy with their stamp of receipt

If you have no intentions of filing a complaint, does that mean that you really want the scammers to get away with what they have done to you, to your hard earned money, and to your family's future? If so, no wonder there are so many ponzi schemes and pyramid scams, one after the other, because victims like you don't do anything to teach scammers and swindlers a lesson.  So if you don't get your money back and whoever swindled YOU gets away with it, then who do you think is to blame - the swindlers, the government, or YOU?

Also, for those victims who live in any country other than the Philippines, PLEASE BE AWARE that you can, and should, actually file your criminal complaint with the respective government agencies (including your own version of the Anti-Money Laundering Council) in the country where you now reside.  And you might get even better and faster results than you would get from the very slow wheels of justice in the Philippines.
